WHY DO WE NEED YOUR EXPLICIT CONSENT TO USE COOKIES?
The AEPD Guide of July 2023, with the contribution of information and criteria from the European Data Protection Board (EDPB), GDPR-EU-2016/679, articles 5, 6, 7 and 13, and LOPDGDD-3/2018, article 6, must be interpreted in the sense that consent will only be valid if it is explicit.

If the child is under 16 years old, such processing shall only be lawful if and to the extent that consent is given or authorized by the holder of parental responsibility or guardianship over the child.
- The data controller shall make reasonable efforts to verify in such cases that consent was given or authorized by the holder of parental responsibility or guardianship over the child, taking into consideration available technology.
The data subject may exercise the rights of access, portability, restriction, objection, rectification and deletion of data and file a complaint with the relevant Supervisory Authority.
WHAT ARE COOKIES?
Cookies are small data files received on the terminal from the visited website and are used to record certain interactions of browsing on a website by storing data that may be updated and retrieved.
These files are stored on the user’s device and contain anonymous data that are not harmful to the equipment. They are used to remember user preferences, such as the selected language, access data or customization of the website or App.
Cookies or storage devices have traditionally been associated with web pages. However, they are currently used both on websites and on other types of platforms and applications (for example, Apps for smartphones and tablets).
Cookies may also be used to record anonymous information about how a visitor uses a site. For example, from which website/App they accessed it, or whether they used an advertising “banner” to arrive there.
Information society services may be provided by the publisher through a platform, software application or website/App accessed by the user from their terminal device.
- WHY DO WE USE COOKIES?
We use our own and third-party cookies to analyze the use of the website and display advertising with preferences based on a profile created from the user’s browsing habits.
MALLANETS SLU uses Technical and Analytical cookies for our website that will allow you to use secure areas, personalized options, etc. In addition, MALLANETS SLU uses cookies that collect data related to website usage analysis. These are used to improve the service to the user by measuring the use and performance of the website, in order to optimize and personalize it.
- Google Cookie, ANALYTICS: Google ANALYTICS is a free service offered by Google Inc. that collects information about the consulted web pages, at what time, which web browser, etc. Subsequently, this information is sent to Google Inc. servers.
- WHAT USE DO WE GIVE TO THE DIFFERENT TYPES OF COOKIES?
According to their purpose:
- Technical cookies: These are cookies that allow the user to browse through a website, platform or application and use the different options or services. For example, those used for session maintenance, response time management, performance or option validation, using security elements and sharing content.
- Preference or personalization cookies: These are cookies that allow information to be remembered so that the user accesses the service with certain characteristics that may differentiate their experience from that of other users, such as language, the number of results to display when the user performs a search, the appearance or content of the service depending on the type of browser through which the user accesses the service or the region from which the user accesses the service, etc.
- Analysis or measurement cookies (analytics): These are cookies that allow the party responsible for them to monitor and analyze the behavior of users of the websites or Apps to which they are linked, including the quantification of advertising impacts. The information collected through this type of cookie is used in measuring the activity of websites, applications or platforms, in order to introduce improvements based on the analysis of the usage data made by users of the service.
- Advertising cookies: These are cookies that, processed by the administrator of the App or by third parties, allow us to analyze your Internet browsing habits so that we can show you advertising related to your browsing profile. Advertising cookies allow the management of advertising spaces based on specific criteria.
These are cookies that store information on users’ behavior obtained through the continuous observation of their browsing habits, allowing a specific profile to be developed in order to display advertising based on it.
Type of cookies according to the length of time they remain active:
- Session cookies: These are cookies designed to collect and store data while the user accesses a website/App. They are usually used to store information that is only relevant to keep for the provision of the service requested by the user on a single occasion (for example, a list of purchased products) and disappear when the session ends.
- Persistent cookies: These are cookies in which the data remain stored on the terminal and can be accessed and processed for a period defined by the cookie controller, which may range from a few minutes to several years. In this regard, it should be specifically assessed whether the use of persistent cookies is necessary, since privacy risks could be reduced through the use of session cookies. In any case, when persistent cookies are installed, it is recommended to reduce their duration to the minimum necessary according to the purpose of their use.
The legal obligations imposed by the regulations are twofold: the obligation of transparency and the obligation to obtain the explicit consent of the website user.
According to the nature of their business activity, the business model they develop and the scope of their responsibility, it is recommended to carry out a review of the cookies used, either internally or with the advice of specialized entities.
This review will aim to identify the cookies being used, analyzing whether they are own or third-party cookies, session or persistent cookies, and specifying their function in order to determine whether they fall within the scope of article 22.2.
Taking into account the possible changes that may occur in the management and use of cookies, it is recommended to periodically carry out this review in order to update the available information about these cookies. In any case, it is recalled that the solutions implemented to comply with the obligations of article 22.2 of the LSSI must be technologically neutral and therefore must be solutions recognized by most browsers.
3.- LINK FOR COOKIE IDENTIFICATION:
It is advisable that the information through which cookies are managed (including how to revoke consent and delete cookies) be available in an accessible and permanent manner at all times through the relevant website, application or online service.
For these purposes, and without prejudice to other solutions that may be adopted, it shall be considered that this requirement is fulfilled when the cookie management system (configuration panel or a CMP, which allows website or App owners to obtain, manage and disseminate consumers’ consent) is integrated into the cookie policy itself or when this policy includes a link that leads directly to the management system or configuration panel.
AEPD Guide, 3.2.10. Possibility of denial of access to the service in case of rejection of cookies:
There may be certain cases in which failure to accept the use of cookies prevents access to the website or the total or partial use of the service, provided that the user is properly informed about this and an alternative, not necessarily free of charge, for access to the service without the need to accept the use of cookies is offered.
These cookies must comply with GDPR-EU-2016/679, LOPDGDD-3/2018, the regulations of LSSI-CE-34/2002, updated 09/05/2023, and the GUIDE on the use of cookies of July 2023, from the AEPD with EDPB criteria.
